USER AGREEMENT TERMS AND CONDITIONS

These terms apply to all users who utilize the services provided by Miller Carter Yazılım Anonim Şirketi via the website www.ustatyemek.app and its mobile application (collectively referred to as “ustatyemek.app“).

1. PURPOSE OF SERVICES

• Informational Purposes Only: Users acknowledge that all content, including but not limited to recipes, images, and posts shared on the platform, is provided for informational and advisory purposes only.
• Age-Restricted Content: Certain content may be intended for users over the age of 18. The platform shall not be held liable for the unauthorized access or viewing of such content by minors.

2. TERMS OF USE & USER RESPONSIBILITIES

• Personal Responsibility: Each user is solely responsible for every transaction, content piece, and behavior they conduct on the platform.
• Health & Allergy Disclaimer: Recipes shared on the platform do not constitute medical advice, diagnosis, or treatment. Users are solely responsible for verifying ingredients against their own allergies, intolerances, or specific health conditions. The application shall not be liable for any direct or indirect damages or health issues arising from the use of shared content.
• Account Security: Users are responsible for maintaining the confidentiality of their account credentials. The platform is not liable for any loss or damage resulting from incorrect information provided during registration or unauthorized account access.
• Intellectual Property: All software, design, and services are the intellectual property of Miller Carter Yazılım A.Ş. Users are prohibited from reproducing, distributing, or modifying these materials without prior written consent.
• Prohibited Content: Users shall not share content that is threatening, defamatory, racist, or violates the laws of the Republic of Turkey or international treaties.
• Regulated Substances: In compliance with legal regulations, users are strictly prohibited from sharing content that encourages the consumption of tobacco or alcohol products.

3. RIGTHS AND AUTHORITIES OF USTATYEMEK.APP

• Modification of Service: The platform reserves the right to temporarily or permanently suspend or modify its services at any time without prior notice or liability.
• Content Moderation: The platform may, at its sole discretion, back up, edit, or delete user-generated content and messages to ensure compliance with its policies.
• Usage License: By sharing content on the platform, users grant ustatyemek.app a non-exclusive, royalty-free right to process, share on social media, or utilize such content within its internal systems.
• Monetization: The platform reserves the right to introduce paid features or transition free services into membership-based paid tiers.

4. DATA AND PRIVACY

• Data Rights:app retains all intellectual property rights to the data and statistics generated through the use of the system.
• Aggregated Reporting: The platform may share anonymized demographic reports or statistics with third parties, ensuring that no personally identifiable information is disclosed.
• Compliance: User data is processed and stored in accordance with legal obligations and the platform’s Privacy Policy.

5. HOSTING PROVIDER STATUS

• In accordance with Law No. 5651 (Republic of Turkey), Ustatyemek.app acts as a Hosting Provider.
• The company is not responsible for the legality of user-published content but maintains a “notice and take down” policy to remove unlawful content upon official notification.

6. JURISDICTION & TERMINATION

• Governing Law: This agreement is governed by the laws of the Republic of Turkey.
• Dispute Resolution: Any disputes arising from this agreement shall be resolved exclusively by the Courts and Execution Offices of Istanbul.
• Termination: Either party may terminate the agreement at any time. Any rights or obligations incurred prior to the date of termination shall remain enforceable.
