MEMBERSHIP AGREEMENT

These terms apply to all users who benefit from the services provided by Miller Carter Yazılım Anonim Şirketi through the website www.ustatyemek.app and its mobile application (collectively referred to as “ustatyemek.app“), which offers experience sharing, e-journals (blogs), comments, discussions, and related content.

1. Scope and Purpose

• Applicability: These terms apply to both registered members and non-registered visitors (collectively referred to as “Users”).
• Nature of Content: All shares, recipes, and images on the system are strictly for recommendation purposes.
• Age-Restricted Content: Some content may be intended for users over 18; the platform is not liable for unauthorized viewing of such content.

2. User Obligations and Liability

• Personal Responsibility: Users are solely responsible for every transaction, content piece, and behavior they conduct on the platform.
• Health Disclaimer: Recipes shared on the platform do not constitute medical diagnosis, treatment, or advice. Users are exclusively responsible for checking ingredients against their own allergies or health conditions.
• Account Security: Password protection is the user’s sole responsibility; the platform is not liable for damages arising from unauthorized password use.
• Content Prohibitions: Users agree not to share content that is threatening, defamatory, racist, or contrary to the laws of the Republic of Turkey. This includes avoiding promotional content for tobacco or alcohol.
• Intellectual Property Transfer: Users agree that by posting comments or content, they transfer all economic rights (processing, reproduction, distribution) under Law No. 5846 to ustatyemek.app.

3. Authorities of Ustatyemek.app

• Service Modification: The platform may suspend or stop operations at any time without liability to users or third parties.
• Content Management: The platform has the authority to backup or delete user files and messages at its discretion and in accordance with legislation.
• Moderation: The platform is free to decide whether to publish user comments and may edit them for spelling or compliance with publication criteria.
• Legal Disclosure: The platform is obligated to provide user personal information to authorities if requested in accordance with the law

4. Paid Services and Payments

• Paid Features: Access to certain “Premium Services” may require one-time or recurring fees.
• Automatic Renewal: Subscription fees will be automatically billed on the first day of each billing cycle until the subscription is officially cancelled.
• Free Trials: If a free trial is offered, users must cancel before the trial period expires to avoid being automatically charged for the subsequent billing cycle.
• Cancellation: Users may cancel their subscriptions at any time via account settings. However, no refunds will be provided for the remaining days of the current, already-paid billing period.

5. Hosting Provider Status

• Per Law No. 5651, ustatyemek.app acts as a hosting provider.
• It is not responsible for unlawful content published by users but reserves the right to remove such content upon notification.

6. Legal Jurisdiction and Termination

• Applicable Law: This agreement is subject to the laws of the Republic of Turkey.
• Authorized Courts: Istanbul Courts and Enforcement Offices have jurisdiction over disputes.
• Termination: Either party may terminate this agreement at any time; rights and obligations incurred until the date of termination remain enforceable.
